Is Retatrutide Legal?

Short answer: Retatrutide is not approved by the FDA and cannot be legally prescribed or compounded โ€” no legal prescription pathway has been identified. It is legally available only to participants in Eli Lilly's clinical trials. Anyone selling it online as a "research peptide" is selling an unapproved drug โ€” and the FDA is actively prosecuting them.

What the FDA says

The FDA states that retatrutide (and the related cagrilintide) "are not components of FDA-approved drugs and have not been found safe and effective for any condition." Eli Lilly has confirmed retatrutide "is legally available only to participants in Lilly's clinical trials" (FDA).

Because retatrutide is not on the FDA's compounding lists (503A/503B bulks lists), compounding pharmacies cannot legally make it either (Health Law Alliance).

The "research use only" loophole is not a loophole

Online sellers label retatrutide as "for research use only โ€” not for human consumption" and claim this makes sales legal. The FDA rejects this. In a March 31, 2026 warning letter to a peptide vendor, the FDA explicitly stated that the "research use only" framing does not exempt the products, classifying them as unapproved new drugs and misbranded drugs under the Federal Food, Drug, and Cosmetic Act (FDA warning letter).

The FDA has sent 50+ warning letters to GLP-1/peptide sellers, including waves in September 2025 and March/April 2026, threatening seizure and injunction.

Is it a controlled substance?

No. Retatrutide is not DEA-scheduled โ€” it is not on the Controlled Substances Act lists. The legal exposure for selling it comes from the FD&C Act (unapproved/misbranded drug), not from drug-scheduling laws (Peptides Dossier).

The real-world safety risk

Unapproved retatrutide sold online is unregulated. The FDA has documented hospitalizations linked to unapproved GLP-1 products, and in 2026 unapproved retatrutide was reported being sold in Brooklyn bodegas โ€” a stark illustration of how far outside the regulated supply chain these products sit (Eastern Herald). Because there is no oversight, the contents, purity, and sterility of a vial bought outside the regulated system cannot be verified.
